TERMS OF USE

Conditions for the provision of electronic services

1. The content of these regulations sets out the rules for selling a range of products remotely, as well as using the online store, electronically.
2. The content of these regulations – in the scope of services provided electronically – the regulations referred to in art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws 2002, No. 144, item 1204, as amended).
3. The Biocannamed.eu store publishes information about its offer on the Biocannamed.eu website via the Internet and allows you to buy goods available in the Online Store database.
4. The contract for the provision of electronic services is concluded at the time of placing an order in the Biocannamed.eu Online Store.

Terms of Sale

1. All prices of goods in the online store are given in PLN and include all VAT taxes.
2. All prices on the website of the online store do not include any shipping costs, which will be listed separately.
3. Final prices are visible when adding the item to the cart.
4. The buyer chooses the delivery method and payment method. The order price presented at that time includes all additional fees giving the final amount that guarantees the correct performance of the sales contract.
5. The Biocannamed.eu Online Store reserves the right to make changes on a regular basis both in the prices of goods offered by the seller and in the amount of fees for delivering goods to the buyer. Each change does not affect the purchases of customers who made them online or concluded a sales contract before any changes to the price list were made.

Payment method

1. The buyer has the option of making payment for the ordered goods, at his own choice, both by transfer in the full value of the order to the bank account provided by the service provider as well as cash in the form of collection upon delivery, where the payment is collected by courier at the time of delivery of the goods.

Delivery form

1. Purchased goods are delivered to the buyer, at his choice both through the postal operator and courier.
2. The delivery of store assortment is not limited to the area of the Republic of Poland and takes place to the address indicated by the consumer in the confirmed order.

Cost of delivery

1. The cost of delivery is borne entirely by the buyer, according to the price list set by the postal operator or courier.

Guarantee of compliance for goods, complaint handling procedures

1. The Biocannamed.eu Online Store as a seller is liable to the buyer for the compliance of the goods with the concluded contract of sale, to the extent specified by the Act on special conditions of consumer sales and amendment to the Civil Code of 27 July 2002.
2. In the event of non-compliance of the goods with the contract before the expiry of the seller’s liability period, the buyer is obliged to notify the seller of the situation.
3. The buyer should immediately send the goods advertised or hand them over to the seller. The transferred goods should meet the basic aesthetic requirements.
4. If the claims of the customer (buyer – consumer) are justified, the seller reimburses the buyer who registered the complaint for the costs of regular delivery.
5. If the item under complaint by the buyer does not comply with the concluded contract, then the buyer has the right to demand that it is made compliant with the concluded contract, including through exchange for a new one.

Return of goods, exercise of the right of withdrawal

1. The buyer has the right to withdraw from a remote contract for a period of ten days without giving reasons and without incurring any costs.
2. In order to withdraw from the contract, the consumer can submit any unequivocal statement in which he informs about his decision to withdraw from the contract, i.e. by e-mail, post or even by phone.
3. The burden of proof of exercising the right of withdrawal under the provisions of this article lies with the buyer.
4. The Biocannamed.eu Online Store shall immediately return all amounts received from the consumer.
5. The seller returns the payment using the form of payment that is possible at the moment after consulting the consumer.
6. The buyer immediately returns the goods to the seller.
7. Returned goods should be unaltered.
8. The buyer covers only the cost of direct return of goods.

Exchange of goods

1. The Biocannamed.eu Online Store enables the exchange of purchased goods for other goods. After prior agreement between the parties to the contract, the buyer may withdraw from the distance contract, at the same time expressing the will to include the amount due as a prepayment for a new order.

Final Provisions

1. Information about the products (in particular their descriptions, properties, prices) placed on the websites of the Biocannamed.eu Online Store does not constitute an offer within the meaning of the Civil Code. Pursuant to art. 71 of the Civil Code, they are considered an invitation to conclude a contract.
2. In matters not covered in the regulations, the provisions of Polish law, in particular the Civil Code (Journal of Laws 1964.16.93) and the provisions of the Act on special conditions for consumer sales and amendments to the Civil Code (Journal of Laws No. 141 of 2002, item 1176) and the Act on the protection of consumer rights and liability for damage caused by a dangerous product (Journal of Laws No. 22 of 2000, item 271) shall apply.
